TERMS & CONDITIONS


YOUR ACCEPTANCE OF THIS AGREEMENT

Each time you purchase a product from Dune Volt Pty Ltd, you acknowledge and agree to be bound by these Terms and Conditions as they apply at the time of purchase. Your purchase signifies your acceptance of this Agreement and the acceptance of any person you claim to represent.

By purchasing from Dune Volt Pty Ltd, you represent and warrant that you have the legal authority to accept these Terms on behalf of yourself and any person or organisation you represent.

If you do not agree with any part of these Terms and Conditions, or if you are not authorised to accept them on behalf of another person, you must not purchase products from Dune Volt Pty Ltd.

These Terms apply to all sales of products supplied by Dune Volt Pty Ltd, including but not limited to electric bicycles, clothing, accessories, components, batteries, and any other goods offered by the company.


LIABILITY

To the fullest extent permitted by law, Dune Volt Pty Ltd shall not be liable for any special, indirect, incidental, or consequential damages arising from the purchase, ownership, or use of its products, even if the company has been advised of the possibility of such damages.

Dune Volt Pty Ltd accepts no responsibility for any accident, misuse, abuse, loss, injury, or damage caused to the rider or to any third party. This includes incidents relating to e-bike power, speed, incorrect parameter settings, component failure, mechanical defects, electrical faults, or product malfunction.

Customers assume full responsibility and liability for all products and components purchased from Dune Volt Pty Ltd, including but not limited to electric bikes, lithium-ion batteries, electrical wiring, braking systems, mechanical components, maintenance, and servicing.

Customers are responsible for understanding and complying with all safety requirements and regulations relating to the storage, charging, transport, and use of lithium-ion battery packs.

Dune Volt Pty Ltd accepts responsibility only for quality control relating to manufacturing standards and supplier selection. Customers are responsible for ensuring that products are maintained correctly and used safely.

Information provided through manuals, product literature, and website content is intended to assist customers in using products safely. However, potential risks may exist beyond those specifically described.

Except where prohibited by law, the sole remedy under any implied warranty shall be limited to the repair or replacement of defective parts with those of equal or greater value, at the sole discretion of Dune Volt Pty Ltd.

Except where prohibited by law, Dune Volt Pty Ltd shall not be liable for property damage, personal injury or death, fire incidents, loss of use or opportunity, loss of contract or profits, business interruption, or any direct or indirect consequential damages.

All riders are responsible for complying with all traffic regulations and restrictions set by applicable State and Federal Governments.


STREET LEGALITY

Where an electric bicycle is described as street legal, this indicates that, to the best of our knowledge, the product complies with applicable Australian electric bicycle regulations and is generally classified as a bicycle rather than a motor vehicle.

This typically means that the product does not require vehicle registration, number plates, insurance, or a driver’s licence to operate.

However, laws and regulations may vary between states, territories, and local councils. Customers are responsible for confirming that the use of their electric bicycle complies with the laws and regulations in their local area.

The term “street legal” does not guarantee access to all bicycle paths, parks, or trails, as certain areas may have additional restrictions on electric bicycle use.

Dune Volt Pty Ltd is not responsible for any fines, damages, penalties, or legal consequences resulting from the use of electric bicycles in locations where their operation may be restricted or prohibited.


WARRANTY

If any original component is found to be defective due to manufacturing fault or workmanship during the applicable warranty period, Dune Volt Pty Ltd may repair or replace the defective component.

The warranty period is twelve (12) months for the bicycle frame and twelve (12) months for electrical components.

This warranty does not cover normal wear and tear, improper assembly, accidents or misuse, insufficient maintenance, abuse or negligence, or the installation of unauthorised parts or accessories.

Any modification to the bicycle frame, electrical system, or components will void the warranty.

The warranty covers replacement parts only and does not include labour costs, transportation costs, or service fees.

The warranty may also be void if the bicycle is used for purposes outside normal use, including commercial use or failure to follow the instructions provided in the owner’s manual.

Tyre punctures are considered normal wear and are not covered under warranty.

If a product is inspected and determined not to be defective, Dune Volt Pty Ltd reserves the right to seek reimbursement of reasonable inspection or diagnostic costs.

The company shall not be responsible for any consequential or indirect damages arising from product defects.


WATER EXPOSURE

Electric bicycles and their components are water resistant but not waterproof.

Products may be ridden in light or moderate rain conditions but must not be submerged in water or exposed to excessive water.

Bicycles should not be cleaned using a water hose or high-pressure equipment and should instead be cleaned with a damp cloth.

Damage caused by water penetration is not covered under warranty.


ASSEMBLY ADJUSTMENTS

Due to shipping and transportation vibrations, certain components may require adjustment during assembly.

This may include adjustments to brakes, derailleurs, or other mechanical parts.

Instructions for assembly and adjustment are available through the company website.

Costs incurred from third-party technicians or bicycle shops are not covered under warranty.


COSMETIC MARKS DURING SHIPPING

In rare circumstances, minor cosmetic marks such as small paint scratches may occur during shipping.

Where appropriate, Dune Volt Pty Ltd may provide a paint touch-up sample to address minor cosmetic marks.

Replacement requests solely due to minor cosmetic scratches that do not affect product performance cannot be accepted.


AUSTRALIAN CONSUMER LAW

The benefits provided by this warranty are in addition to rights and remedies available under Australian Consumer Law, which cannot be excluded.


WARRANTY CLAIMS

Proof of purchase is required for all warranty claims.

If a fault occurs, customers must contact Dune Volt Pty Ltd through the website or designated support email.

Customers may be asked to provide photographs, videos, diagnostic information, or troubleshooting assistance to help identify the issue.

Our technical team will review the information provided and determine whether the issue is covered under warranty.

If the cause of the fault cannot be determined, Dune Volt Pty Ltd may choose to repair or replace the product in favour of the customer.

Replacement parts such as batteries, motors, LCD displays, or controllers may be supplied for testing or replacement.

Customers may be required to have basic tools or technical ability to assist with remote troubleshooting.

Shipping costs associated with returns, exchanges, or warranty claims are the responsibility of the customer unless otherwise required by law.


SHIPPING POLICY

Dune Volt Pty Ltd guarantees delivery of all orders.

If an item is lost during shipping, a replacement will be provided at no additional cost. However, the company is not responsible for delays caused by courier services.

All deliveries require a signature upon delivery.

If no one is available to receive the delivery, a redelivery fee may be charged.

If a package arrives damaged, the customer must take photographs and request written damage confirmation from the courier.

Customers may be required to assist with courier claims in cases of shipping damage.


RETURN POLICY

This return policy applies only to orders placed through the official website.

Return shipping costs are the responsibility of the customer.

Products must be returned in their original packaging. If the original packaging is unavailable, a refund may not be granted.

If damage occurs during return shipping due to improper packaging, the cost of repairs will be the responsibility of the customer.

All returns must receive written approval via email from Dune Volt Pty Ltd before being shipped.


AFTER SALES SERVICE

For services outside warranty coverage, customers may still be required to provide proof of purchase.

If a product was purchased second-hand, customers should obtain the original purchase documentation in order to request support.


USER SUBMITTED CONTENT

By submitting reviews, photos, videos, testimonials, or service requests to Dune Volt Pty Ltd, customers grant the company permission to use, reproduce, or share that content for marketing, promotional, or support purposes without payment of royalties.


WEBSITE ERRORS

Dune Volt Pty Ltd is not responsible for typographical, pricing, or illustrative errors that may appear on the website or in marketing materials. Such errors will be corrected once identified.


DELIVERY AND SUPPLY

Delivery timeframes provided by Dune Volt Pty Ltd are estimates only.

The company will make reasonable efforts to meet estimated delivery times but will not be liable for delays that are outside its control.


CANCELLATION

If circumstances arise that prevent the delivery of products or services, Dune Volt Pty Ltd reserves the right to cancel the order and notify the customer in writing.


FORCE MAJEURE

Performance obligations may be delayed or cancelled due to events beyond the reasonable control of Dune Volt Pty Ltd. These events may include natural disasters, war or civil unrest, government actions, labour disputes, equipment failures, power shortages, epidemics, pandemics, or similar events.

Where such events occur, obligations under these Terms may be suspended for the duration of the event.


DEFINITIONS

Customer refers to the person or entity purchasing products or services from Dune Volt Pty Ltd.

Force Majeure Event refers to any event beyond reasonable control that prevents the fulfilment of obligations under these Terms and Conditions.
